Educational Services for Overseas Students Act

Under Federal legislation to protect international students, the University must include its provider code – from the Commonwealth Register of Institutions and Courses for Overseas Students (CRICOS) – on certain web pages.

The Educational Services for Overseas Students Act 2000 (ESOS Act) aims to protect and enhance the international reputation of Australian educational institutions.

In accordance with the Act, all providers registered to offer courses to people studying in Australia on student visas, including Australian universities, are listed in the Commonwealth Register of Institutions and Courses for Overseas Students (CRICOS), and each has a unique number.

The inclusion of the CRICOS code on web pages ensures that overseas students know that they are dealing with a properly registered organisation.

UWA staff who are responsible for University sub-sites should familiarise themselves with the summary information on the ESOS legislative framework.

CRICOS Provider Code for UWA

The CRICOS Provider Code for the University is 00126G.

Under section 107 of the Act, all registered providers must cite their CRICOS number on every item of publicity in which overseas students may be invited to enrol in one of their courses. This applies to printed publications and electronic publications, including email and the web.

Requirement for UWA web pages

We must put the CRICOS number where prospective students are most likely to be looking or believe they are being invited to enrol. For example, on the pages that include details of courses, enrolment information, contacts, homepages.

That is, everywhere we:

  • make an offer to an overseas student or an intending overseas student to provide a course in WA
  • invite an overseas student or intending overseas student to undertake, or to apply to undertake, a course in WA
  • hold ourselves out as able or willing to provide the course in WA to overseas students.

Email

Emails sent to prospective students must also contain the University’s CRICOS number.

Penalties

This excerpt from the Act sets out the penalties for failing to provide your CRICOS number.

Section 107 Failing to identify registered provider in written material:

  1. A person is guilty of an offence if the person in written material, including in electronic form:
    1. makes an offer to an overseas student or an intending overseas student to provide a course in a State to that student; or
    2. invites an overseas student or intending overseas student to undertake, or to apply to undertake, a course in a State; or
    3. holds himself, herself or itself out as able or willing to provide the course in a State to overseas students;
    and the material fails to identify:
    1. the registered provider for the course; and
    2. the number allocated to the registered provider under section 10; and
    3. any other information prescribed by the regulations.

Maximum penalty: Imprisonment for six months.

“This does not mean every provider has to include its number on every page in every piece of electronic information. It means pursuing the objectives of s107 of the Act thoughtfully and practically.” Department of Education and Training 2001.
